Agreement to our legal terms
Foundation for Affordable Housing ("Foundation," "we," "us," or "our") operates this website and related products and services that link to these Terms (collectively, the "Services"). You may contact us through Amy Sugden, Transactions Manager, at contact@ffah.org or by mail at 69 Newport Ave. Suite 200, Bend, Oregon 97703, United States.
These Terms form a legally binding agreement between you and the Foundation. By accessing or using the Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must stop using the Services.
We may update these Terms from time to time. The date above identifies the latest revision. Your continued use of the Services after revised Terms are posted means you accept the changes.
The Services are intended for users who are at least 18 years old.
1. Our services
Information available through the Services is intended for use in jurisdictions where doing so is lawful. If you access the Services from another location, you are responsible for compliance with local laws.
The Services are not designed to satisfy industry-specific requirements such as HIPAA, FISMA, or GLBA. Do not submit regulated information through the Services unless we have expressly agreed in writing to appropriate safeguards.
2. Intellectual property rights
Unless otherwise stated, we own or license the software, website design, text, photographs, graphics, logos, trademarks, and other content made available through the Services. These materials are protected by intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access the Services and download or print portions of the content solely for your personal or internal business use. No content may be copied, reproduced, sold, licensed, published, or exploited for commercial purposes without our prior written permission.
Questions about permitted use may be sent to contact@ffah.org.
3. User representations
By using the Services, you represent and warrant that:
- The information you provide is accurate, current, and complete.

- Your use of the Services will not violate any applicable law or regulation.
4. Accounts and payments

Fees, deposits, payment schedules, accepted payment methods, and program- or partnership-specific obligations will be shown at checkout or stated in a separate agreement. If those terms conflict with these website Terms, the signed agreement controls.
You agree to provide current and accurate billing information and authorize us and our payment providers to charge the amounts you approve. Taxes and fees will be disclosed when applicable.
5. Prohibited activities
You may use the Services only for their intended purpose. You may not:
- Systematically retrieve, scrape, harvest, or compile data from the Services without written permission.
- Circumvent security features, interfere with the Services, introduce malicious code, or overload our systems.
- Use bots, scripts, spiders, or other automated tools except standard search-engine indexing.
- Impersonate another person, submit false information, harass others, or use information obtained from the Services to harm anyone.
- Copy, reverse engineer, frame, mirror, or use the Services to build a competing product or service.
- Use the Services for fraud, spam, unlawful solicitation, or any purpose that violates applicable law or another person's rights.
6. Submissions and feedback
Information you send through contact forms, applications, reviews, or other interactive features must be lawful and must not infringe another person's rights. You remain responsible for what you submit.
If you voluntarily send us ideas, suggestions, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and share that feedback for any lawful purpose without compensation or attribution. This does not change how personal information is handled under our Privacy Policy.
7. Services management
We may monitor the Services, investigate suspected violations, restrict access, remove content, or take appropriate legal action to protect the Foundation, our residents, partners, or others. We are not obligated to monitor every activity or submission.
8. Privacy
Our Privacy Policy explains how we collect, use, and disclose personal information. By using the Services, you acknowledge that policy. The Services are hosted in the United States, and information may be processed in the United States.
9. Term and termination
These Terms remain effective while you use the Services. We may suspend or terminate access, including an account, if we reasonably believe you violated these Terms, created risk or possible legal exposure, or used the Services unlawfully. Obligations that by their nature should survive termination will survive.
10. Modifications and interruptions
We may modify, suspend, or discontinue any part of the Services at any time. We do not guarantee uninterrupted or error-free availability and are not liable for downtime, maintenance, or discontinuation to the fullest extent permitted by law.
11. Governing law
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
12. Dispute resolution
Before filing a claim, you agree to contact us at contact@ffah.org and attempt in good faith to resolve the dispute informally for at least 30 days. Unless applicable law requires otherwise, any court proceeding arising from these Terms or the Services must be brought in the state or federal courts serving Deschutes County, Oregon, and each party consents to those courts' jurisdiction and venue.
13. Corrections
The Services may contain typographical errors, inaccuracies, or omissions, including descriptions, availability, and pricing. We may correct or update that information at any time without prior notice. A signed agreement controls over general website content.
14. Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE SECURE, ACCURATE, COMPLETE, OR UNINTERRUPTED.
General information on the website is not a substitute for a consultation or a signed agreement.
15. Limitations of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOUNDATION AND ITS DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM USE OF THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID THROUGH THE WEBSITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
16. Indemnification
You agree to defend, indemnify, and hold harmless the Foundation and its directors, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable legal fees arising from your misuse of the Services, your breach of these Terms, or your violation of another person's rights.
17. User data
We may maintain information you submit to operate the Services. Although we take reasonable steps to protect and back up information, you are responsible for retaining copies of information important to you. Our handling of personal information is described in the Privacy Policy.
18. Electronic communications and signatures

21. Miscellaneous
These Terms, the Privacy Policy, and any posted policies constitute the agreement governing website use. A separate signed agreement may govern a specific program or partnership. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights without our consent; we may assign ours as permitted by law. These Terms do not create a partnership, employment, or agency relationship.
